These Terms govern your use of qaxal.com and its sub-domains, including go.qaxal.com (together, the "Site"). The Site is published by Qaxal s.r.o. ("Qaxal", "we", "us").
Qaxal s.r.o. is a Slovak limited liability company, IČO 55 900 526, DIČ 2122126281, VAT ID SK2122126281, with registered seat at Ulica Adama Štrekára 8131/19, 917 08 Trnava, Slovakia, registered in the Commercial Register of the District Court Trnava (Obchodný register Okresného súdu Trnava), Section Sro, Insert No. 55543/T. The contact address for any matter under these Terms is legal@qaxal.com.
By using the Site you accept these Terms. If you do not accept them, do not use the Site.
1. What these Terms do and do not cover
These Terms cover the Site. They are not the terms on which we provide services.
- The Digital Identity Platform is governed by the DIP Terms of Service at
dip.qaxal.com/legal/terms, together with the Data Processing Agreement atdip.qaxal.com/legal/dpa. - Consulting and delivery engagements are governed by the separate written agreement signed by both parties.
Where one of those documents conflicts with these Terms, that document wins for everything within its scope.
2. What the Site is
The Site is an informational and marketing publication. Nothing on it is an offer capable of acceptance, and nothing on it forms a contract. Descriptions of services, capabilities, methods, prior work, pricing, and availability are general and indicative, reflect our position when written, and change without notice.
We take on work only through a signed agreement or, for DIP, through acceptance of the DIP Terms at sign-up.
3. No professional advice
Content on the Site is general information about data infrastructure, measurement, and AI integration. It is not professional, legal, tax, or regulatory advice, and it is not a substitute for advice on your own circumstances. In particular, material touching on GDPR, the ePrivacy Directive, consent, or tracking is general commentary and not a compliance opinion for your business. Do not act on it, or decline to act, without appropriate professional input.
4. Booking a call
Where you book a call or submit an enquiry through the Site, you agree to give accurate information and to tell us if it changes. Booking a call creates no obligation on either side beyond attending, or telling the other party you cannot.
We may cancel or reschedule a booking, and we may decline to proceed with an enquiry, without giving reasons.
How we handle the personal data in a booking is set out in the Privacy Policy.
5. Acceptable use
You may read the Site, and quote or link to it with attribution. You may not:
- use it for any unlawful purpose, or to help anyone else act unlawfully;
- attempt to gain unauthorised access to the Site, its hosting infrastructure, or any connected system;
- probe, scan, or test the vulnerability of the Site without our prior written permission;
- interfere with the Site's operation, including by denial-of-service or by placing unreasonable load on it;
- scrape, harvest, or systematically extract content in order to build a competing offering or a commercial dataset;
- submit false or misleading information through any form, or book calls in bad faith or at volume;
- misrepresent your affiliation with us, or use our name or marks in a way that suggests an endorsement or partnership that does not exist;
- remove or obscure any proprietary notice.
We may restrict or block access if you breach this section.
6. Intellectual property
All content on the Site, including text, layout, design, graphics, code, and the Qaxal name and marks, is owned by us or licensed to us and protected by copyright, trade mark, and other intellectual property law.
You receive no licence beyond the limited permission in Section 5 to read, quote with attribution, and link. Everything else, including reproduction, adaptation, redistribution, and use in training or fine-tuning a machine-learning model, requires our prior written consent.
Third-party names and marks on the Site, including client logos where shown, belong to their owners. Their appearance indicates a working relationship where stated and implies no endorsement of you.
7. Availability
We provide the Site as-is and as-available. We do not promise it will be uninterrupted, timely, error-free, or free of harmful components, and we may change, suspend, or withdraw any part of it at any time without notice.
8. Third-party links and embedded services
The Site links to and embeds third-party services, including our scheduling provider. We do not control them and are not responsible for their content or their practices. Their own terms and privacy notices apply to your use of them.
9. Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for damage caused intentionally or by gross negligence, and liability for harm to health or life, under Slovak law.
Subject to that, and to the fullest extent permitted by law:
- we exclude all warranties relating to the Site, whether express or implied, including as to accuracy, completeness, or currency of content;
- we are not liable for lost profit, lost revenue, lost data, lost business, or lost goodwill, or for any indirect or consequential loss, arising out of or connected with your use of the Site;
- our total aggregate liability arising out of or connected with the Site will not exceed one hundred euro (EUR 100).
This section governs the Site only. Liability under the DIP Terms or under a signed engagement agreement is dealt with in those documents and is not affected by this section.
10. Business use
The Site and our services are directed at businesses. By booking a call or submitting an enquiry you confirm that you do so in the course of your trade or profession. Where you are nonetheless a consumer under Slovak or EU law, nothing in these Terms deprives you of rights you have under mandatory consumer-protection law.
11. Text messaging (SMS)
Who we are and what you can expect. Qaxal s.r.o. builds data infrastructure for businesses: server-side tracking, data pipelines, warehouses, business intelligence, and AI integration. Where you give us your mobile number and separately consent, we send text messages of two kinds, and you choose each one independently:
- Customer care and non-marketing messages, for example confirming a call you booked, appointment reminders, rescheduling, and replies to a support request or an enquiry you started.
- Marketing messages, for example special offers, discounts, event invitations, and service announcements.
Consent is optional and separate. Each message type has its own checkbox. Neither is ticked in advance, neither is bundled with email consent, and neither is a condition of submitting a form, booking a call, or buying anything from us. You may opt into one, both, or neither.
How to opt out. You can cancel the SMS service at any time. Just reply STOP to any message you receive from us. After you send the message STOP to us, we will send you a message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
How to get help. If you are experiencing issues with the messaging programme you can reply with the keyword HELP for more assistance, or you can get help directly at legal@qaxal.com.
Carrier liability. Carriers are not liable for delayed or undelivered messages.
Message frequency and costs. As always, message and data rates may apply for any messages sent to you from us and to us from you. Message frequency varies and depends on what you asked for and which consents you gave. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.
Privacy. If you have any questions regarding privacy, please read our privacy policy: https://qaxal.com/legal/privacy. Section 2(b3) of that Policy explains exactly what we do with your mobile number and your consent.
12. Privacy and cookies
Our handling of personal data, and the cookies we set, are described in the Privacy Policy. That Policy is a separate transparency notice under the GDPR. It applies to you whether or not you accept these Terms, and it does not form part of them.
13. Governing law and forum
These Terms, and any dispute arising out of or connected with them or the Site, are governed by the law of the Slovak Republic, excluding its conflict-of-laws rules and excluding the UN Convention on Contracts for the International Sale of Goods.
The competent court at our registered seat has jurisdiction. Where you are a consumer, the mandatory jurisdiction rules of your country of residence apply instead.
14. General
If any provision is held unenforceable, the rest stays in force and the unenforceable provision is limited to the minimum extent necessary. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them as part of a merger, acquisition, or sale of assets.
15. Changes
We may revise these Terms. The Effective Date and Version above always reflect the current text. Continuing to use the Site after a revision means you accept it.
